Topic: ERISA Compliance Overview
Speaker: Terral J. Smith, Partner, Conner & Winters Attorneys and Counselors at Law
CTCBA is proud to host Terral J. Smith as our guest speaker for the upcoming May luncheon. Terral is a Partner with the law firm of Conner & Winters.
Mr. Smith's presentation will focus on the overall goal of maintaining sound plan documents, developing/maintaining plan process and procedures that will spot and correct problems, and will outline and discuss the interaction of the applicable agencies in the plan's ongoing maintenance and compliance process. Topics will include:
* Conducting a Basic Plan Review
* Pension Plan Compliance Issues (IRS and ERISA)
* Welfare and Health Plan Compliance Issues (ERISA and HHS)
Attendees will:
* Learn the basic processes for maintaining ERISA and IRS compliant benefit plans.
* Learn how to identify and correct compliance issues.
* Gain understanding of the IRS and DOL enforcement focus for pension and welfare plans.
Mr. Smith's practice focuses on employee benefits and employment law. He has extensive experience with plan design and compliance involving pensions, health and welfare benefit plans, apprenticeship training plans, vacation plans, multiemployer plans, litigation and advice, employee benefits arbitrations, and federal collections. He frequently advises fiduciaries regarding mergers, spin-offs, and acquisitions of employee benefit plans. He also counsels clients regarding compliance with Health Insurance Portability and Accountability Act (HIPAA) issues, Qualified Domestic Relations Orders (QDRO's) and Qualified Medical Child Support Orders (QMCSO), and Consolidated Omnibus Budget Reconciliation Act (COBRA), and Pension Protection Act (PPA) issues. Mr. Smith has successfully handled many pension dispute arbitrations involving complex ERISA issues and has trial experience in federal employment claims.
Mr. Smith holds a B.A. from Washington University and JD from the St. Louis University School of Law.
